These Terms of Service ("Terms") govern access to and use of the Rinkalyze website, platform, and related services (the "Platform") operated by Matthew Hicks, doing business as Rinkalyze ("Rinkalyze," "we," "us," or "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Relationship to Service Agreement
If you are using the Platform on behalf of a league, organization, or other entity that has entered into a Service Agreement with Rinkalyze, that Service Agreement governs billing, data rights, termination, and business terms.
In the event of a conflict between these Terms and a Service Agreement, the Service Agreement controls.
2. Eligibility and Accounts
- The Platform is intended for adult hockey leagues and their participants
- You must be at least 18 years old to create an account
- You represent that any information you provide is accurate and current
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activity occurring under your account
Rinkalyze may suspend or terminate accounts that violate these Terms.
3. Use of the Platform
You may use the Platform only for its intended purpose: statistical tracking, reporting, and informational display related to hockey leagues.
You agree not to:
- Harass, abuse, or threaten other users or Rinkalyze staff
- Impersonate another person or entity
- Scrape, crawl, or extract data using automated tools
- Reverse engineer, decompile, or attempt to access source code
- Upload malware or malicious content
- Interfere with Platform performance or security
- Use the Platform for unlawful purposes
- Resell, sublicense, or provide unauthorized access to the Platform
4. Content and User Submissions
Users may submit content such as:
- Scores and statistics
- Team and player information
- Logos, images, and text
You represent that:
- You have the right to upload the content
- The content does not violate laws or third-party rights
- Any content involving minors complies with applicable laws and required consents
By submitting content, you grant Rinkalyze a non-exclusive, royalty-free license to host, display, and process the content solely to operate and improve the Platform.
5. Statistics, Accuracy, and Informational Use
The Platform provides informational statistics only.
- Statistics may be incomplete, delayed, or inaccurate
- Automated, OCR-based, or AI-assisted features may produce errors
- You are responsible for reviewing and verifying data
- Rinkalyze is not the official recordkeeper for any league
6. Public Visibility
Certain league data (such as standings, statistics, and schedules) may be publicly visible and indexed by search engines unless disabled through Platform settings.
You are responsible for configuring visibility preferences where available.
7. Intellectual Property
All Platform software, design, code, calculations, analytics, and features are the exclusive property of Rinkalyze.
You may not:
- Copy or modify Platform materials
- Use Rinkalyze branding without permission
- Create derivative works from the Platform
8. Privacy
Your use of the Platform is subject to Rinkalyze's Privacy Policy, which explains how data is collected and used.
Rinkalyze acts as a data processor for league data.
Leagues are responsible for compliance with applicable privacy laws.
9. Suspension and Termination
Rinkalyze may suspend or terminate access to the Platform at any time if you:
- Violate these Terms
- Engage in abusive or harmful behavior
- Attempt to compromise Platform security
- Use the Platform unlawfully
Termination may occur without prior notice where necessary to protect the Platform or other users.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."
RINKALYZE DISCLAIMS ALL WARRANTIES, INCLUDING:
- ACCURACY OR COMPLETENESS OF STATISTICS
- UNINTERRUPTED OR ERROR-FREE OPERATION
- FITNESS FOR A PARTICULAR PURPOSE
- SECURITY OR AVAILABILITY
USE OF THE PLATFORM IS AT YOUR OWN RISK.
11. Limitation of Liability
To the maximum extent permitted by law, Rinkalyze is not liable for:
- Lost data or statistics
- Business interruption
- Lost revenue or profits
- Reputational harm
- Indirect or consequential damages
Some jurisdictions do not allow certain limitations, so these may not fully apply.
12. Indemnification
You agree to indemnify and hold harmless Rinkalyze from any claims arising from
- Your use of the Platform
- Your submitted content
- Violations of these Terms
- Disputes involving your league or users
13. Changes to These Terms
Rinkalyze may update these Terms from time to time.
Material changes will be posted on the Platform.
Continued use of the Platform after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
